This happens (especially because HASS requirements are so weird), so they opted to stay another year in order to finish up and graduate. One day, towards the end of this students senior year, a small skirmish took place on the dorms e-mail list between this senior and an undergraduate in the dorm. Senior Wow, way to make an insulting, totally useless reply to the entire dorm. Undergraduate uhh, he is graduating, right? and graduating people, i presume, wont be staying in the dorm over the summer. so, if my two assumptions are true, i admire [name]s heroism for taking time out of his busy final study schedule to make sure that the portion of summer residents who watch movies are happy. oh, if youre not graduating (whether youre not a senior or otherwise), sorry, thats all i meant by the comment. Wow. I had no idea there were so many interpretations of this song. For me it’s always been clear: the song is about an execution. Here’s the set-up (all of this is proven later): The narrator has committed murder. He might have done this out of malice, or self-defense, or anything in between; we don’t know. The fact is that he killed someone, was caught and sentenced, and is now on Death Row. The man is not an important person, so to speak. He is not famous, nor rich, nor anything of the kind. He has no high-priced lawyers and no â€Å"connections† to help him in his plight. The narrator implies that, if he had higher social status, if he had money or fame or whatever, then he would stand a good chance of escaping death. But alas, he is merely a â€Å"poor boy† (aka ordinary person), and has no such power. His family and friends are attending the execution (or have otherwise heard about it), and are very distressed. Conversely, the family and friends of the dead man want revenge and they can’t wait to see the narrator executed. The song takes place just prior to the execution, and involves the narrator talking to (or perhaps just thinking about) his mother, just before he dies. If you’re still reading, you have my thanks. Here’s the line-by-line analysis: *We start with the narrator’s thoughts: â€Å"Is this the real life? Is this just fantasy? † *The narrator is overwhelmed by the idea that he’s going to die. He almost wonders whether this is all a nightmare or something. â€Å"Caught in a landslide, No escape from reality† Again, he feels overwhelmed, but he can’t really deny that he’s about to be killed. I think that he’s really just sadly reflecting on what he’s done, and he mentions this to his mother (or perhaps he’s just thinking about her) â€Å"Mama, life had just begun But now I’ve gone and thrown it all away† He was a young man, in his 20s perhaps. He had the chance to live a meaningful life, but instead he killed a man, thus causing his own death via execution. The narrator laments, noting that he could have saved his own life by choosing not to murder. But now the deed is done, and the narrator will face justice. â€Å"Mama, ooh, Didn’t mean to make you cry If I’m not back again this time tomorrow carry on, carry on as if nothing really matters† Again he’s sorry for his actions, and regrets that his mother now weeps for him, as he will soon be killed. The execution will take place within the hour, so if he’s not back again this time tomorrow, it will mean that the execution happened on schedule, that he failed to escape it via pardon or other means. The narrator tells his mother that, even if he dies, she should carry on living, almost as if his death didn’t matter to her. â€Å"Too late, my time has come† The execution is imminent. â€Å"Sends shivers down my spine, body’s aching all the time† These are symptoms of his intense fear. â€Å"Goodbye, ev’rybody, I’ve got to go† He says a final farewell to his family and friends. Gotta leave you all behind and face the truth† The truth is that he killed a man, and now he faces strict justice. He will die. â€Å"Mama, ooh, I don’t want to die I sometimes wish I’d never been born at all† This much is obvious. He doesn’t want to be killed, and indeed he wonders if it would have been better never to have been born in the first place. (Galileo. ) Galileo, Galileo figaro† Galileo was unfairly persecuted by the authorities of his time. Granted, Galileo didn’t commit murder, but the narrator’s advocates still draw a parallel, insisting that he doesn’t deserve the punishment he’s receiving . â€Å"Magnifico. I’m just a poor boy and nobody loves me† The narrator repeats the common belief. â€Å"He’s just a poor boy from a poor family Spare him his life from this monstrosity† His friends and family argue that, because he’s a poor boy, he deserves sympathy and compassion, not death. â€Å"Easy come, easy go, will you let me go† Here the narrator pleads for his life. He basically says â€Å"You don’t seem to care about me; I’m ‘easy come, easy go’. You don’t really care if I live or die. So, if you don’t really care whether I live or die, can’t you just let me live? Can’t you grant me a pardon or something? â€Å" Then the opposite group, the friends and family of the dead man (and/or the execution authorities) respond to these pleas. â€Å"Bismillah! No, we will not let you go† The other group wants the narrator to be executed. â€Å"(Let him go! ) Bismillah! We will not let you go (Let him go! ) Bismillah! We will not let you go (Let me go. ) Will not let you go (Let me go. ) Will not let you go. (Let me go. ) Ah No, no, no, no, no, no, no. † The two groups have a spirited argument. â€Å"(Oh mama mia, mama mia. ) Mama mia, let me go† Here the chorus of friends and family says â€Å"let me go†, but I really think they mean â€Å"let him go. Don’t kill the narrator† â€Å"Beelzebub has a devil put aside for me, for me, for me† Beelzebub means Satan. The narrator feels (or speculates) that Satan is out to torment him by leading him to such a sad fate. After all, it was probably a devil that tempted him to commit murder in the first place. Likewise, his family feels Satan is tormenting them as well, by killing the narrator to make them feel sad. Perhaps even the dead man’s family joins in on this chorus; they feel that it was Satan who told the narrator to commit murder in the first place, and now they insist that execution is the only holy esponse to such a sin. Throughout this, the narrator has been lethargic and morose. But right before the end, he has a sudden burst of passion. â€Å"So you think you can stone me and spit in my eye? So you think you can love me and leave me to die? Oh, baby, can’t do this to me, baby Just gotta get out, just gotta get right outta here! † Iâ€⠄¢m not sure if he’s talking to anyone specific here, or if he’s just ranting with passion, screaming at everyone and everything involved. As I imagine it, the narrator throws off his guards and fights to escape from his shackles. In the ensuing musical piece, he struggles with the executioners, knocking the room into disarray. The two families watch closely, but everyone knows it’s a useless struggle; there’s simply no way for the narrator to escape. And the end of the musical piece, he is beaten down and finally subdued. Once again he become morose and dispirited, and the executioners drag him to his place of death (electric chair, perhaps). In his last few moments before death, the narrator resumes his previous state of mind. Nothing really matters, Anyone can see Nothing really matters Nothing really matters to me† Again, because he’s about to die, nothing really matters to him. He has no purpose, no hope, nothing. â€Å"Any way the wind blows†¦ † This is an allusion to the begining of the song, where this image was used along with â€Å"nothing really matters† So†¦ yeah. Chapter three of this book is titled â€Å"Bitches and Morons and Skanks, Oh My! : What Reality TV Teaches Us about Women† and the author goes into further detail of the stereotypes of women shown in reality television. Pozner provides her readers with examples from reality television shows, such as The Real Housewives of New Jersey, The Bachelor, Americas Next Top Model, The Hills, Flavor of Love, and many more to help prove the point that reality television stereotypes women. On shows like these women are shown getting in something called â€Å"catfights† often. These fights are over so many dumb things. Most of the time it is fighting over men. When viewers see things like this they begin to get the idea in their head that women are catty back stabbers. Pozner acknowledges the fact that â€Å"If millions of TV viewers believe that sisterhood is not powerful but spiteful, it becomes all that much harder for women to achieve any further social progress in America. † (Pozner 108). Her point is that women need not let these shows affect them in the real world. Not only are women shown as backstabbers, but they are also shown as stupid. Just about everyone today has had to herd of the saying â€Å"dumb blonde. † This saying is influenced by reality television but not only for blondes, but for women in general. Pozner emphasizes on the fact that â€Å"Time and time again, we learn that the female half of the population is cringe-inducingly stupid. † (Pozner 108). She continues to say, â€Å"In embarrassing scenes across unscripted subgenre, women are portrayed as ‘the dumber sex’† (Pozner pg. 109). Pozner also provides a great example from the popular show Bridezilla that mostly women watch. It is a quote from the show that say’s â€Å"Thinking is a waste of time. Thinking is for people who have no brains† (Pozner 109). This is only one example, but it clearly proves that reality television is trying to get this idea into women’s heads and make woman look stupid. Another example for the stereotypes of a â€Å"dumb blonde† and woman in reality television, are the shows The Simple Life with Paris Hilton and Nicole Richie, and The Newlyweds with Jessica Simpson. All of these women are publicized doing and saying stupid things on the shows. For example, Jessica Simpson was not sure if Chicken of the Sea Tuna was tuna or chicken, which made her look stupid. Both these shows are known to be reality television shows but they are actually scripted. According to Pozner, â€Å"Both Hilton and Simpson have said they were just ‘playing characters’ on The Simple Life and The Newlyweds. These media-savvy young women have intentionally played up their airhead images to heighten their fame and their already-overflowing bank accounts†. That is smart on their part to make more money, but these fake reality television shows that are making them look stupid, becomes a bigger issue in society because people are starting to think that women are stupid. Pozner compares these shows to the bigger social issues that they cause by saying â€Å"After all, less than one hundred years ago, American women were still denied the ability to vote, partly justified by the allegation that they were less intelligent than men† (Pozner 116). She says, â€Å"Today, class action lawsuits are still being levied against Fortune 500 corporations that refuse to promote women out of secretarial and retail positions based on institutional biases that consider women not as mentally prepared as men for achievement and leadership. † (Pozner 116). People might not think that it is a big deal that reality television portrays these girls and woman as stupid, but it is leaking into society and definitely affects the way companies and people think and act towards women. Pozner cites a fact that. According to Nielsen Research, U.  S. television viewership hit record highs in 2008 and continues to rise. By 2009, the average American watched more than thirty-one hours of TV per week† (Pozner 132). If people are watching this much reality television it will definitely change the way society thinks because they are so used to seeing women as stupid on these shows so they will think they are stupid in the real world too. Stereotypes of self-image in both men and women are very common in reality television as well. Most of the time these shows are more focused on the way woman look. Modeling shows such as Americas Next Top Model stereotype women as being very skinny and beautiful. According to Martin Eisend and Jana Moller, the authors of, The Influence of TV Viewing on Consumers Body Images and Related Consumption Behavior, â€Å"Particularly females have not only biased perceptions and beliefs regarding body shapes but they obviously feel pressure to conform to those standards as well† (Eisend and Moller 103). When woman see these â€Å"perfect† skinny and beautiful models on these shows, they strive to be like that, and sometimes it can be unhealthy mentally and physically. Eisend and Moller explain how â€Å"Biased media images of ideal female beauty seem to contribute to the fact that one woman out of every two is dissatisfied with her body. † (Eisend and Moller 103). The stereotypes of beautiful women on these shows are manipulating the way women and men are thinking. Just because someone is so perfect on these reality television shows makes the viewer feel like they are not good enough or not good looking enough. Jenifer L. Pozner discusses the issue of these stereotypes in the way woman look too. Pozner observed that, â€Å"nearly every reality TV dating show has reinforced the idea that women are unworthy of love and happiness if they are not stereotypically beautiful. † (Pozner 70). Pozner quotes Mike Fleiss, the executive producer of The Bachelor. He says, â€Å"When we are looking for the bachelorettes we take all kinds of things into consideration. There are physical tests, there are blood tests, but most important – they have to look good in the hot tub. † (Pozner 71). This proves that these stereotypes of beautiful woman are put on these shows on purpose. Pozner talks about a show that’s called More to Love and deals with overweight people instead of the ideal beautiful woman. The show attempted to help viewers accept fat people a little more but it still continued to stereotype a lot. Pozner argues, â€Å"Plus size women who embrace their curves; have happy dating histories, and enjoy exercise, vegetables, and sex exist in the real world – but not on this show. Instead, viewers were treated to near-constant shots of zaftig women chowing down on pizza or meat-on-a-stick and crying about how they’d be doomed to a spinster’s life if the three-hundred-pound male star didn’t pick them, More to Love was supposed to be an inspirational show for people who are not in the best shape or not as fit, but failed to be inspirational and stereotyped fat people even more. America’s Next Top Model tried to be inspirational with a woman named Toccara Jones, and failed to do so too. Toccara was one of the first plus size models on the show, 180 pounds and a 38DDD. Throughout the begging of the show she was a fan favorite with a lot of confidence. As the show got later in the season the judges started to dislike her, and Pozner says she was put on the show as a â€Å"plus-size participant, who are set up to be broken down. Pozner revels that, â€Å"Toccara is recognized as one of the most successful African American plus-sized models working today. To reality TV producers, she’s just a fat Black girl who needs to lose weight† (Pozner 82). This is a perfect example of how reality television stereotypes looks and body image. It is more than just a little bit of stereotyping too. There are much bigger social issues that are leaked out in to society because of this stereotyping. There was a girl named Luisel Ramos who worked for a modeling agency over seas. She suffered a heart attack and died right after a beauty pageant contest because of health issues. She only weighed 97 pounds and had a body mass index of 14. 5, which is very unhealthy. This is because modeling agencies want all of their models to be as skinny as possible even though there are health hazards and risks involved. Even though this terrible tragedy happened, modeling agencies still want there models on diets, keeping them from gaining weight, in fact, they want them on diets that make them lose even more weight. Pozner talks about a judge from Americas Next Top Model named Janice Dickinson who said, â€Å"I’m dying to find kids who are too thin. I’ve got 42 models in my agency and I’m trying to get them to lose weight. In fact, I wish they’d come down with some anorexia. I’m not kidding. I’m running into a bunch of fat-assed, lazy little bitches who don’t know how to do the stairs or get their butts into the gym†¦ Models are supposed to be thin. They’re not supposed to eat. † (Pozner 84) This goes to show people how ignorant and terrible these modeling agencies are, even after knowing people have died from being so skinny and unhealthy. This proves that it is not only in reality television anymore, but it is a terrible and dangerous stereotype in the real world, too. The stereotype of a so-called â€Å"ugly† person is another problem in reality television. It is not only weight that’s involved, but there are also stereotypes of people who are not good looking enough. Susan Boyle is a perfect example for this. Su Holmes wrote a scholarly article on this subject called â€Å"Dreaming a Dream: Susan Boyle and Celebrity Culture†. Holmes talks about Susan Boyle who was a contestant on the reality television show called Britain’s Got Talent. Susan Boyle is not the best-looking person out there and she suffered a mental defect since birth, but she has so much talent singing opera. Her singing surprised the judges and so many viewers around the world just because the average stereotyped â€Å"ugly† person on reality television normally is not perceived as having much talent. Holmes referenced a quote from Tanya Gold who was a journalist for the Guardian, which is a news company in the UK. Tanya Gold said, â€Å"Why are we so shocked when ‘ugly’ women can do things, rather than sitting at home weeping and wishing they were somebody else? † (Holmes 75). This is very true. It was only a big deal to people because she was ugly. If she were the â€Å"average good-looking woman† her talents and story would not even be a big deal. This is why reality television needs to stop with all of this stereotyping because it is interfering with the way people see things and interfering with true talent. A very big stereotype in reality television is race. Many viewers of reality television it seems as if minorities or other groups of people that are not white are stereotyped and pointed out in some way. Thomas E. Ford, a Western Michigan University graduate wrote a scholarly article titled, Effects of Stereotypical Television Portrayals of African-Americans on Person Perception. As read in the title, his article obviously talks about stereotyping African Americans. Ford examines that African Americans portrayed on reality television â€Å"were more likely to have low socioeconomic status† (Ford 267). This is a quite common conception that blacks are poor and that blacks don’t have the same socioeconomic status as whites do. If reality television continues to portray this idea, the minds of viewers and young people all across the world will slowly continue to believe ridiculous things like this. A more recent scholarly article written by Mark P.  Orbe called Representations of Race in Reality TV: Watch and Discuss also gives great example of stereotyping race in reality television. Orbe gives an example from the show The Real World on MTV. Many times in the show, black males are seen as violent. Orbe agree to the fact the society starts to think this way too. Orbe said, â€Å"Other work has drawn attention to representations of African Americans males on MTV’s The Real World, specifically to how it’s programming format contributes to the hegemonic power of racial images and reinforces societal fears of black men† (Orbe 350). These are only few examples of many, but clearly reality television does, in fact, stereotype race. To sum it all up, reality television needs to change its way of portraying the topics of gender, self-image, and race. The amount of reality television that people are watching is only making it worse, too. The more viewers that are shown these stereotypes, the more it will become a reality, which is something that has happened slowly over many years. There are most certainly alternatives to stereotyping and still maintaining viewers for reality television. If producers keep it up and keep stereotyping, society will continue to be influenced by it. As mentioned before, these examples are only a few of hundreds of examples of how reality television stereotypes. Although viewers think reality television does not use stereotypes, based on all of these examples and many more, stereotyping of gender, self image, and race does exist in reality television, and is done because these shows know viewers will continue to watch, which leads to influencing the way society acts, thinks, and feels towards others.

Dissociation occurs spontaneously and the individual has not control over the schedule. What most of the studies show is that if a person has multiple identities, it is related most of the time to child abuse, and in that case, because stats show there a high frequency of child abuse, about one person out of 100 has split personality or something close to it. As a Senior HR Manager, I do believe there is impact of the minimum retirement age act in company and industry as well. Implementation of the new minimum retirement age act could be beneficial to the company. Based on the survey done by the group Aon Hewitt (2011), 53% out of the 107 companies that participated in the survey thinks that they will lose their talented employees. Furthermore, some companies also worry that they could not find the replacement for their talented senior employees due to the lack of talents in the market (Aon Hewitt, 2011). According to Tung and Comeau (2012), company that offer job rotation for the senior workers could save the cost of hiring new employees. Some senior employees are talented, still productive, and have many experiences that the younger employees do not have. Senior employees can share their experiences and knowledge, lead, and guide the newly hired employees. This could also help the company to save the cost of hiring outside trainer to train their new employees. However, there are drawbacks towards the company for implementing the new Act. Some company would face cost structure disruption due to the Act as mentioned by the Malaysia Employers Federation (Aruna Rahim, 2012). The senior employees have higher payroll than those younger ones. Some company could not afford higher wages employees and hence would face the financial problem due to the Act. Furthermore, some senior employees might face some health problem as they age and this would increase the company’s cost due to the medical bills (Tung Comeau, 2012). This would be a burden to the company especially those small-medium enterprises (SMEs). Besides the company, there are also some impacts of introducing the new retirement age act on industry field. According to Li (n.d.), delaying the retirement age from 55 to 60 can brings an impact on those fresh graduates or young employees. It is because the vacancies that were previously prepared for them which following the retirement of the older employees are delayed. He also stated that the pre-MRAA case of Sistem Penerbangan Malaysia Berhad had successfully argued in the Industrial Court on increasing the retirement age from 55 to 66 could cause frustration and stagnation of junior employees who failed to promote to the senior position as the senior staff only retires at the age of 60. Besides that, he also mentioned that the productivity of older employees may decline with age which lowers the performance of the organization. Some other disadvantages associated with older employees include inflexibility in executing tasks, unwilling to learn new knowledge, difficult in mainta ining up-to-date skills, and reluctance to take part in any training programs. Apart from that, Malaysian Employers Federation (MEF) Executive Director, Y. Bhg. Datuk Hj. Shamsuddin bin Bardan also claimed that the unemployment rate could rise from 3.7% to 4% or higher as the industry field is forced to subdue the loss in job openings as employee retires later (FreeMalaysiaToday, 2013). He said that the Malaysian job market is not well-prepared for the entering of new fresh graduates if the present employees do not leave the job market at the age of 55. In the other hand, new retirement age act can bring some long-term benefits (Chew, 2013). He proposed that by elongate five more productive years, the gross domestic product (GDP) of the national economy could be raised by extra 400 000 workers. He also said the government deficit can be reduced significantly as the workers working longer and contribute to the Employees Providence Fund (EPF) by continuing paying income tax. Last but not least, the contributions and taxes from the private sector can be reduced. This is because with the increase of revenue and surplus from the government, the income tax and other tax incentives from the private sector can be reduce. Based on Code of Practice on the Prevention and Eradication of Sexual Harassment in the Workplace which established by Ministry of Human Resources, Malaysia in 1999, sexual harassment means â€Å"any unwanted conduct of a sexual nature having the effect of verbal, non-verbal, visual, psychological or physical harassment: that might, on reasonable grounds, be perceived by the recipient as placing a condition of a sexual nature on her/his employment; or that might, on reasonable grounds, be perceived by the recipient as an offence or humiliation, or a threat to his/her well-being, but has no direct link to her/his employment. Based on The Code, sexual harassment of Sally case is fall on sexual annoyance, a sexually-related conduct that is offensive, hostile or intimidating to the recipient, but nonetheless has no direct link to any job benefit. In Sally case, the sexual harassment was fall into category of harassment by an employee against another employee. From the text above, the co-worker of Sally were whistles, leers, comments about her sexy physical body, one of the crew members whom name Al, even grabbed Sally and tried to kiss her. Sally was refuge what Al did on her. The action did by Al and co-worker were an unwanted conduct of a sexual nature having the effect of physical, verbal, non-verbal and visual which can be counted as a hostile environment sexual harassment. She was harmed due to the unsuccessful of resolving her sexual harassment problem by her supervisor, Chunk. She has been told to be calm. Apart from this, the co-worker isolates her and refuge to work with her. She develops an ulcer and used all her sick leave and being diagnosed having job-related stress and took 60 days of leave-of-absence. Her fiancà © also break their engagement because of peer pressure. Besides, she also failed to appeal regards on her sexual harassment case by both the union and management. b) If you were the union or Chunk, how would you investigate her grievance? If no witnesses supported Sally’s story, what would you conclude? Grievance is being defined as the â€Å"dissatisfaction between the employees and the employers involving the work and working environment† (Zulkiflee Daud, Mohd Faizal Mohd Isa, Wan Shakizah Wan Mohd Nor, Zairani Zainol, 2013, p. 123). In terms of this context, Sally claimed that she was being sexually harassed by one of the crew member, Al, where he tried to grab her and kiss her when Sally was being sent out in truck with Al. However, Al denied in having any physical contact with Sally. Sally’s case is considered as individual grievance whereby formal stage grievance procedures will be taken to investigate this case. So, if I were the union or Chuck, I will initiate with the grievance procedure once I received the complaint lodged by Sally. But before that, I need to ensure that I understand thoroughly what have been written in the grievance/complaint form by Sally and to have a basic idea on Sally’s situation and why she lodged the complaint. Then, I will write an acknowledging receipt of the grievance statement and proposed some advises on the ways to handle the grievance to Sally within the 5 working days from the day the grievance are being received. Next, I would proposed for an investigation to be done onto Sally’s grievance by developing a separate complaint procedure that deals specifically with such a sexual harassment complaints as this is a very sensitive issue in an organization. In developing the complaint procedure, Sally would be protected from any further embarrassment in the course of investigation into the complaint, for instance, being continuously shunned by the crew of the utility company. There are three main elements in a complaint procedure; first element is the step-by-step procedure within a time frame given for each step in the process of reporting and processing the complaint lodges by the aggrieved person, second element is conducting an investigation procedure, and last element in the complaint procedure is to come out with an appeal procedure that enable the dissatisfied party to re-appeal for an investigation’s findings to a higher authority. Thus, in dealing with the complaints by Sally, I will then request for a complaint Committee, as what may have been outlined in the company’s Code of Practice on the Prevention and Eradication of Sexual Harrassment in the Workplace. The complaint Committee shall includes at least three representatives from the other departments in the company not including the department of the accuser and the accused employee and the representatives shall have a higher position if compared to the employee that complaints and the employee that is being complaint. I shall also consider to go for a member from the outside counsel that is acquainted in dealing with the issue of sexual harassment. Not to forget, I shall go for a complaint Committee where at least half the members of the Complaints Committee are women and it is better to have Women member as the leader of the Complaints Committee. In setting up the Complaints Committee, I will proposed a tentative day, date, and time to the committee involved asking them to come for an investigation session and the committee shall present at the day, date, and time stated. Thus, in conducting the grievance investigation, separate interview will be held for both the aggrieved person (Sally) and the one who cause the aggrievation (Al). The interviews are done separately as to minimize the possibility of practicing bias and also to test the validity and reliability of the justification given by the parties involved. Apart from that, the investigation is carried out based on the 5W1H approach; who is involved in this case, what have happened, when did the case happened, where did the case takes place, and how did it happened? Both the parties, the aggrieved party (Sally) and the one who caused the aggrievation (Al) are given the fair chance to clarify and justify themselves. Other than the both parties involved, their colleagues l ike another women crew who also works would be called-in for the investigation session as well to know more about the parties involved, for instance, in terms of their attitudes in their working station and their personalities. After that, the Complaints Committee will come out with the final decision on whether Al is really guilty in sexually harassing Sally or not or it is Sally who has wrongly accused Al. The next step is closely linked to the decision made by the Complaints Committee. For instance, if Al was found guilty in sexually harassing Sally, I shall know what disciplinary actions that could be taken onto Al whether by terminating him without notice and showing him show cause letter or warning letter as the Employment Acts 1955 stated that: The individual found guilty of sexual harassment may be dismissed without notice, demoted or penalized with a lesser punishment, e.g. suspension without pay for a period of up to 2 weeks. Same situation applied to Sally, disciplinary actions will be taken if Sally was found guilty in accusing and maligning Al. It may be the possible that Sally is introverted and comes from a very conservative family background complaint that she was physically and verbally har assed. It might also be the case maybe Al was Sally’s former lover and had end their relationship or Al had fallen on her but she rejected and Al was envy what’s more to know that she had engaged with another man who is also the worker in the same company. If both the parties agreed with the final outcomes, the case is closed. But if both the parties do not agreed with the final outcomes, they are allowed to reappeal and the same investigation step will be carried on again. The investigation step will only come to an end when both the parties are agreed with the final outcomes or when one of the parties is proved to be guilty. In this sexual harassment case, if there is no witnesses that could support Sally’s story, I would conclude that Sally’s story is not valid. Without any strong supporting elements, the validity of Sally’s story is being questioned and without any proves, I have to come out with a conclusion that the sexual harassment do not take places as what have been told by Sally. Sally’s story could only be applicable if there is a strong evidence provided to support that the sexual harassment do take places and it do have the tendency to take place. However, if it really takes place, I will seek solution for the parties who found guilty and also provide some counseling session to help her recover from her emotional and physical injuries. Whether the charges are valid or not, I will transfer Sally to other department if she agrees to avoid the conflict between Al, the crew and herself which might affect her performance or given special attention on the welfare and saf ety of Sally if she has to work at night. c) How might this scenario have been prevented? This scenario can be prevented through several ways which are organization should develop policy statement prohibiting sexual harassment, provide training to employee and employer and take all the complaints of sexual harassment seriously. The organization should develop policy statement prohibiting sexual harassment. Based on The Code, policy statement on sexual harassment is a published message to all the members in organization which aim to create non-sexual harassment working environment. From the Sally case, it is clearly shown the co-worker doesn’t have a clear understanding on what sexual harassment is. A clear definition of sexual harassment is required include in the policy so that employee and employer can understand it and try to avoid doing it. Secondly, through provide training to employee and employer also can prevent sexual harassment. An effective policy, tied with training for all employer and employee will help in preventing harassment (Prevention of Sexual Harassment, n.d.). The training should teach what is sexual harassment is, procedure to complaints when facing such situation and etc. This can create awareness for all the staff to prevent sexual harassment with the knowledge gained during the training session. Lastly, the upper management should take complaints seriously rather treat it as small case. From the Sally case, we could see that her supervisor doesn’t treat it seriously. Instead of taking action on Al but the supervisor ask to keep her sense of humor and he just asked Al to keep his hands to himself. In fact, this obviously is a sexual harassment case and should take action quickly so that Sally’s right is protected. Due to the failure of taking complaint seriously, Sally being isolated by the co-workers and force to took leave because of job-related stress. It is important for the upper management especially immediate supervisor to take complaints seriously, take action on it, and figure it out whether sexual harassment exists or not. This is to ensure that the victim can be protected from being harass again. In conclusion, this scenario can be prevented through develop policy statement prohibiting sexual harassment, provide training to employee and employer and take all the complaints of sexual harassment seriously. This is to ensure Sally’s case won’t happened again.
